W elcome to https://www.womeninmining.org.uk, the website of the UK network of Women in Mining (the “Website”).

These terms and conditions (the “Terms”) together with our privacy policy, govern Women in Mining’s relationship with you in relation to your use of the Website. Please read these carefully. By using the Website, you indicate that you accept the Terms and our privacy policy and that you agree to abide by them. Do not use the Website or continue using the Website if you do not agree to them.

We may revise these Terms and any other legal notice on the Website without notice. All changes will be effective when posted on the Website. You should check the Website from time to time to review these Terms and other legal notices because they are binding on you. The current version of the Terms will be displayed on this page of the Website.

1. Information about us

The Website is operated by Women in Mining Limited, a company registered in England and Wales under company number 6123099 and whose registered office is at 55 Baker Street, London, W1U 7EU. Women in Mining Limited is referred to as “Women in Mining”, “WIM”, “our”, “us” and “we” in these Terms and our privacy policy and the term “you” refers to you being the user of our Website.

2. Accessing the Website

While we endeavour to ensure that the Website is normally available 24 hours a day, we shall not be liable if for any reason it is unavailable at any time or for any period.

The content of the pages of the Website is for your general information and use only and may be updated or changed without notice. Women in Mining may suspend, discontinue, delete or change all or any part of the Website and the services offered on it at any time without notice. Women in Mining shall not be liable to you or to any other person in the event that all or any part of the Website is suspended, discontinued, deleted or changed in any way.

3. Registration

We may restrict access to some parts of our Website, or our entire Website, to those users who have registered with us. If you choose or you are provided with a username and password as part of the registration process, you must treat that information as confidential and you must not disclose it to anyone else. If you know or suspect that someone else knows your password you should notify us by contacting us immediately at info@womeninmining.org.uk. We have the right to disable any username, password and/or your account at any time if in our opinion you have failed to comply with these Terms.

4. Right to use non-personal information

By submitting information to the Website, you grant Women in Mining a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, fully transferable and sublicensable licence to use, distribute, adapt, modify, incorporate, display, reproduce and transmit such information together with all underlying intellectual property rights to that information irrespective of whether those rights subsist now or come into existence in the future (except personal data which you provide to us and from which you can be identified – please see our privacy policy for further details) for any purpose in any and all media in any manner in whole or in part without any duty to account to you.

5. Unacceptable use

You will not, and will not authorise anyone else to:

  • upload, e-mail or otherwise transmit to the Website any material that is:
    • confidential to you or any other person or entity, or that you do not have the right to disclose to us;
    • racist, sexist, ageist or homophobic, pornographic, obscene, profane, vulgar or horrid, defamatory of any person or entity, abusive, threatening or otherwise likely to be harmful to those persons likely to use the Website, or otherwise offensive in the opinion of Women in Mining;
    • likely to infringe or misappropriate any patent, copyright, trade mark, trade secret or any other intellectual property right of any other person or entity; or
    • a virus, worm or Trojan horse, or any other computer code that is likely to disrupt, overload, harm or impair the functioning of the Website.
  • attempt to impersonate any other person, or otherwise misrepresent your identity, qualifications, affiliations or any other information about you;
  • attempt to disrupt, overload, harm or impair the functioning of the Website; or
  • engage in any conduct that is in contravention of any relevant local, national or international law or which incites or encourages the contravention of any such law, is disruptive or is otherwise inappropriate.

Discussion boards and other user-generated content (such as comments and blogs) on the Website are provided for your use. Views and opinions that are expressed by users are personal to them and may not reflect those of Women in Mining. Women in Mining reserves the right to edit or delete any information submitted to the Website, including without limitation any message which contravenes the rules above. Should you find any message which you feel is in contravention of the above rules, please let us know immediately by sending an email to info@womeninmining.org.uk.

Unauthorised use of the Website may give to a claim for damages and/or be a criminal offence. If you breach these Terms we may suspend or delete your account.

6. Use at your own risk

Your use of any information or materials on the Website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through the Website meet your specific requirements.

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on the Website for any particular purpose. Commentary and other information and materials posted on our site are not intended to amount to advice on which reliance should be placed. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

From time to time the Website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse such website(s). We have no responsibility for the content of linked website(s).

7. Exclusion of liability

To the fullest extent permissible by any applicable law, we and our associated companies, officers, directors, employees, shareholders or agents or any of them, exclude all liability and responsibility for loss or damage of whatever nature (including but not limited to loss of profits or anticipated savings or wasted expenditure) arising from or in connection with your access to or use of this Website, or reliance on the Website, regardless of whether such loss or damage would arise in the ordinary course of events or otherwise, is reasonably foreseeable or otherwise, or is caused by any error or omission in the Website (whether negligent or not), except that nothing affects our liability for death or injury caused by our negligence or any other liability which may not be excluded or limited by law.

Whilst we make reasonable attempts to exclude viruses or other destructive computer codes from the Website, we do not accept any obligation, give no assurance and assume no liability or responsibility (whether express or implied) in relation to viruses or such computer code. You should take all appropriate safeguards before using the Website or downloading from the Website.

8. Intellectual property

The Website contains material and underlying intellectual property rights which are owned by or licensed to Women in Mining. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited except as expressly authorised by Women in Mining.

All trade marks reproduced in the Website, which are not the property of, or licensed to Women in Mining, are acknowledged on the Website.

9. Governing law

These Terms, our privacy policy and your use of the Website are governed by and construed in accordance with the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction to determine any dispute in connection with the Terms, our privacy policy or your use of the Website.

10. General

If any provision of the Terms is deemed unlawful, void or for any other reason unenforceable then that provision shall be deemed severed from the Terms and shall not affect the validity and enforceability of any remaining provisions.

Our failure to exercise or enforce any rights or any provision of the Terms will not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing.

We do not intend the Terms (or any part of them) to be enforceable by any person who is not a party to these Terms pursuant to the Contracts (Rights of Third Parties) Act 1999.
